Terms of sale
Translation provided for information purposes. Only the French version is legally binding. Version française
1. Purpose and scope
These general terms of sale ("Terms of Sale") govern the purchase of the paid plans for coworking space operators (Essential and Pro plans) on the websites coworkingavis.fr and coworkingavis.com. They supplement the terms of use, which continue to apply to the use of the service. In the event of conflict, these Terms of Sale prevail as regards the paid plans.
The paid plans are reserved for businesses and professionals acting for purposes of their trade, business, craft or profession. The customer confirms this when ordering. They are not offered to consumers.
2. Seller
Lëtz Pilot SARL-S, simplified private limited liability company with a share capital of 200 €, 7 avenue du Swing, L-4367 Belvaux, Luxembourg, registered with the Luxembourg Trade and Companies Register under number B311241, VAT number LU37756325, business permit no. 10198840/0. Contact: contact@letzpilot.lu, +352 621 26 56 30.
3. Plans
The plan purchased applies to the customer's operator account and to the listings it manages: one listing for the Essential plan, up to three listings for the Pro plan. The content of each plan is described on the operator plans page on the day of the order. The Free plan remains available without payment.
The Pro plan includes local promotion: in addition to its normal position, the listing may appear in a separate box labelled "Sponsored" at the top of its city page. This promotion does not change ratings, reviews or the order of the main ranking, and no plan allows a review to be published, hidden or edited. Lëtz Pilot does not guarantee any number of visits or reviews or any commercial result.
4. Prices
Prices are stated in euros excluding VAT, per period paid in advance:
- Essential: €29.00 excl. VAT for 1 month; €290.00 excl. VAT for 12 months.
- Pro: €49.00 excl. VAT for 1 month; €490.00 excl. VAT for 12 months.
The annual option costs the price of 10 months for 12 months of access. The amount including VAT is displayed before payment. Lëtz Pilot may change its prices at any time; the applicable price is the one displayed when ordering, and a period already paid is never charged again.
5. VAT
- Customer established in Luxembourg: Luxembourg VAT at 17%.
- Customer established in another EU Member State with a valid intra-EU VAT number (checked in the European Commission's VIES system when ordering): invoiced without VAT, the VAT being due by the customer (mention "Autoliquidation – art. 196 directive 2006/112/CE", i.e. reverse charge).
- Customer established in another Member State without a valid VAT number: Luxembourg VAT at 17%.
The customer guarantees that the VAT number and billing address provided are accurate and informs Lëtz Pilot of any change. The plans are only offered to customers established in the European Union.
6. Order and payment
The customer chooses the plan and duration, enters billing details, checks the summary (price excluding VAT, VAT, total, period), accepts these Terms of Sale and pays by card (or Apple Pay / Google Pay where offered) on the secure payment page of SumUp, a payment service provider. Lëtz Pilot has no access to full card details.
The contract is concluded when SumUp confirms the payment. A numbered electronic invoice is then issued; it is sent by email and can be downloaded from the operator area. The customer accepts electronic invoicing.
7. Duration, renewal and expiry
Each payment gives access to the plan for a period of 1 month or 12 months. The period starts when the payment is confirmed; when the same plan is renewed before expiry, the new period starts at the end of the current period.
There is no automatic renewal: no payment is ever taken automatically. The customer is notified by email and in the operator area 7 days and then 1 day before expiry and may renew by paying for a new period. Without renewal, the plan remains active for a grace period of 7 days after expiry, after which the account automatically reverts to the Free plan; the listing and reviews stay online.
Upgrading during a period: the new period starts immediately and the remaining days of the lower plan are converted, pro rata to the monthly prices, into additional days of the higher plan. Downgrading: possible at the end of the current period.
8. Termination and refunds
The customer may stop using the plan at any time by not renewing it. A period that has started is due in full and is not refundable, except where required by law or in the event of a breach by Lëtz Pilot of its essential obligations.
Lëtz Pilot may suspend or terminate the plan in the event of a serious breach by the customer of the terms of use or these Terms of Sale (in particular manipulation of reviews, unlawful content, payment fraud), after formal notice that has remained without effect for 8 days, except in urgent cases; no amount is refunded in that case. If Lëtz Pilot stops providing a plan for a reason not attributable to the customer, the unused part of the paid period is refunded pro rata.
The right of withdrawal provided for consumers does not apply, as the plans are reserved for professionals.
9. Customer obligations
The customer provides accurate information about its space, holds the rights to the content (texts, photos, links) it publishes and complies with the review policy. It does not solicit reviews in exchange for any benefit and does not post reviews about its own space.
10. Availability and liability
Lëtz Pilot uses reasonable efforts to ensure access to the service (obligation of means), subject to maintenance operations and events beyond its control. Its liability is limited to direct and foreseeable damage and, in total, to the amount paid by the customer for the 12 months preceding the event giving rise to liability. It is not liable for indirect losses (loss of revenue, customers or data). These limitations do not apply in the event of gross negligence or wilful misconduct.
11. Personal data
Billing data is processed to perform the contract and comply with accounting and tax obligations, and is kept for 10 years. See the privacy policy.
12. Changes to these Terms of Sale
Lëtz Pilot may amend these Terms of Sale. The applicable version is the one accepted when ordering; a new version applies to subsequent orders and renewals.
13. Governing law and disputes
These Terms of Sale are governed by Luxembourg law. The parties will first seek an amicable solution (write to contact@letzpilot.lu). Failing that, any dispute falls under the exclusive jurisdiction of the courts of Luxembourg City. As the contract is concluded between professionals, consumer mediation schemes and the European online dispute resolution platform do not apply.
These Terms of Sale are available in French, English and German; in the event of discrepancy, the French version prevails.
